Federal Fair Housing Protections

The federal Fair Housing Act prohibits housing discrimination based on:

  • Religion

  • Sex

  • Familial status

  • Disability

Familial status generally includes households with children under the age of 18, pregnancy, and individuals who have or are in the process of obtaining legal custody of a child.

Montana Fair Housing Protections

The Montana Human Rights Act prohibits housing discrimination based on:

  • Race

  • Color

  • National origin

  • Religion

  • Creed

  • Sex

  • Marital status

  • Age

  • Familial status

  • Physical or mental disability

Protections associated with sex discrimination may also include pregnancy, sexual harassment, sexual orientation, and gender identity to the extent protected under applicable law.

What Fair Housing Laws Cover

Fair housing requirements apply to many aspects of residential real estate, including:

  • Advertising and marketing

  • Responding to inquiries

  • Property showings

  • Offers and negotiations

  • The sale, lease, or rental of housing

  • Terms, conditions, and services

  • Mortgage lending and property appraisals

  • Reasonable accommodations and modifications for people with disabilities

  • Access to housing-related services and organizations

Prohibited conduct may include falsely representing that housing is unavailable, applying different standards or conditions, discouraging someone from pursuing a property, providing different services, or otherwise limiting a person’s housing opportunities because of a protected characteristic.

Retaliation against someone for reporting discrimination, opposing a discriminatory practice, or participating in a fair housing investigation is also prohibited.

Anyone who believes they have experienced housing discrimination may contact one or both of the following agencies. Because filing deadlines may apply, complaints should be made promptly.
